Ark Limited Hardware Warranty
Applicable to Dark Bio Ark hardware devices
1. Warranty Coverage
Dark Bio AG (“Dark Bio”) warrants to the original purchaser that the Ark hardware device will be free from defects in materials and workmanship under normal use for a period of one (1) year from the date of original purchase (“Warranty Period”).
Devices distributed as part of alpha, beta, pre-release, or testing programs, or provided as gifts or promotional units, are not covered by this warranty. Warranty terms for such devices, if any, are determined on a case-by-case basis at Dark Bio’s sole discretion.
2. What Is Not Covered
This warranty does not cover:
- Damage caused by accident, misuse, abuse, negligence, or unauthorized modification.
- Damage caused by operation outside the permitted or intended uses described in the documentation.
- Normal wear and tear, including cosmetic damage.
- Damage caused by service performed by anyone other than Dark Bio or an authorized representative.
- Software, firmware, or data stored on the device.
3. Remedy
If a defect is covered by this warranty, Dark Bio will, at its sole discretion, repair or replace the defective unit. Replacement devices may be new or refurbished. A replacement device assumes the remaining warranty period of the original device.
4. Data and Factory Reset
Warranty service may require a factory reset of the device, which permanently destroys the encryption keys and all data stored on it. Dark Bio cannot access or recover your data. You are responsible for ensuring you have appropriate backups or are prepared for data loss before submitting a warranty claim.
5. How to Make a Claim
To make a warranty claim, contact support@dark.bio with your device serial number and a description of the defect. Dark Bio will provide instructions for return or inspection.
6. Disclaimer
EXCEPT FOR THE EXPRESS WARRANTY ABOVE, THE ARK HARDWARE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES. IN SUCH JURISDICTIONS, THE ABOVE EXCLUSIONS APPLY TO THE GREATEST EXTENT PERMITTED BY LAW.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DARK BIO’S LIABILITY UNDER THIS WARRANTY SHALL NOT EXCEED THE PURCHASE PRICE YOU PAID FOR THE ARK DEVICE.
8. Statutory Rights
This warranty gives you specific legal rights. You may also have additional rights that vary by jurisdiction. Nothing in this warranty limits or excludes statutory rights that cannot be waived under applicable law.
9. Governing Law
This warranty is governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law principles. Any disputes arising under this warranty shall be subject to the exclusive jurisdiction of the courts of Zug, Switzerland.
